POLICY STATEMENT: Important Statutory Warning

1. “Our Artworks, Symbol & Logo are digitally encoded, secured and protected. Violators will be

pursued relentlessly and punished heavily under the law.”

2. Artflares shall never share its buyers’ identity with third party without their consent. However,

we may mention the collector’s name along with such artwork, whether for sale or free distribution,

in our publications.

3. The Artist reserves the right to:

    (a) Create series of any artwork with a different or the same title as sequel # 1, 2, 3 … but with a

    different visual look, and

    (b) Modify, withdraw or reschedule the same, anytime before its final sale.

4. Slight variations in colors when the same art is viewed on different media is natural and thus, tolerable.

5. What’s a Giclee Print? Giclee (jee-klay) pronounced as “shee clay”, is French word that means to squirt:`to eject ink in a spurt or spray’ which defines advancement in printmaking technology. Images are immensely high resolution digital scans printed with archival quality pigmented inks on various

acid-free media such as canvas, fine art and photo-based papers. The process provides superior color accuracy, brilliance, saturation and gradients unsurpassed, virtually by all other means of reproduction. Giclee outdoes traditional silver halide and gelatin printing processes and is widely accepted by the museums and art collectors such as Metropolitan Museum and Museum of Modern Art, New York. Today, the world’s most expensive art is reproduced as giclee prints, and thus the originals are safely stored away for posterity. The greatest advantage with giclee printing is that it can be tailor-sized to suit a client’s demand without sacrificing its originality.

6. Giclee prints are accepted by the Fine Art Guild when appropriately produced. Such prints are

color-fast and guaranteed to last over 80-100 years. It’s a collectable Fine Art that ranks high over lithographs and serigraphs. We employ the latest professional `state-of-the-art’ Epson technology. Epson 8-color Ultra-chrome pigment based inks are stable and produce expanded color gamut of high fidelity beyond that of silver halide printing. Prints are completely warranted against the devastating effects such as, fading, fissures and premature ageing often common to other media.

7. Giclee images come alive so well that even the painter-artist can’t discern them from his original artwork. Giclee prints are bought and sold in auctions worldwide and, their Secondary Markets have grown astronomically over the past decade. Some artists seldom sell their original art but sell only their Limited Editions.

8. Our Limited Giclee Editions (LGEdn. #): 099 Editions only. On an overwhelming worldwide demand for the Limited Giclee Editions of our digitally painted Original Art, we’re extremely honored to formally announce their first-ever release w.e.f. March 15, 2006 -- strictly never, ever more than (99) Limited Giclee Editions this after, of each of our Original Art. They will be individually numbered, dated and signed by the Artist and dully supplied with a Certificate of Authenticity by the artflares.

9. Our Original Giclee Art (OGA): Only one-of-a-kind. The digitally painted Original Giclee Art can also be purchased as one-of-a-kind artwork fully supported by artflares on a very exclusive Certificate of Authenticity supplied by the worldwide honored Hahnemuhle of Germany/ USA which ensures the highest reliability. (Albeit, millions of copies of the world famous old masters’ artworks are in circulation, it’s not lowered the astronomical market value of their Original Art, as original will remain original, always!)

10. Orders, Prices, Payments & Shipments: Order Format is given under `Order’ at our Home Page.

Price, Currency of Payment; Size and Media are mentioned along the second view of each artwork.

Orders prepaid by PayPal, credit cards (VISA, Master Card and American Express), Money Orders or Bank Drafts payable at Toronto, Canada are accepted only. Please, type in the Order Format for this.

Artwork will be sent only on full realization of payment (no part payments, please!).

Our prices include packing, shipment and insurance. Some locations and special deliveries cost extra.

Original Giclee Art carries higher insurance and will cost extra. Please, enquire before ordering.

Sizes are approximate in inches and of the paper. Print will be little smaller. (Scale: 1”=2.54cm). Artwork customized to a special size can also be provided at special rates. Please, enquire.

GST, Duties and Customs if any, are paid by the buyer.

Deliveries may take 2-6 weeks depending on the destination under normal course.

Mounting and framing are a matter of personal choice and, come in a large variety and price range. This also increases freight, insurance and the risk to artwork. Hence, not provided please! (Sorry)!

11. Returns & Refunds: No questions asked, you’re at full liberty to return and get refund (Price minus shipment & insurance as paid by us) provided that the artwork is returned to us intact within two weeks from its receipt, without opening its plastic pouch along with one-way shipment and insurance prepaid by the buyer.

Contact your Customs or Tax Department for adjustments at your end before returning our artwork.

Please, follow instructions about the care and protection of the artwork, pasted over the pouch.

NOTE:            CUSTOMIZED-SIZE ARTWORKS ARE NON-REFUNDABLE!

12. Owners’ Rights: Reproduction of our Original Giclee Art or Limited Giclee Editions for sale, in any

form or by any means such as print, electronic, photographic, digital or adaptation is strictly prohibited.

However, news and print media are welcome to contact us for our written permission to publish our Art provided that they agree to give therein, the citation: Courtesy of the artist’s name, artflares’s website and email address, but they must use our Request Form (Home Page) for this purpose.

13. On purchase, the owners, inheritors and the subsequent buyers of our Original Giclee Art or

Limited Giclee Editions will enjoy the right to auction, sell, gift, donate, barter or exhibit the same without altering or resizing their originality in any case. However, this doesn’t take away the rights

of the artist and artflares to use these images for the purpose as stated above in Para. 2 and 3.

14. Disputes: If any, the claimant shall contact us first with full details in a proper manner allowing us sufficient time for a satisfactory solution before resorting to any other means to seek redress.

All disputes are subject to the jurisdiction of the courts of Toronto, Canada only.

Orders are accepted and executed only on the total acceptance of our current Policy and the related topics mentioned herein.

15. Legal Disclaimer: We do our best to preserve our clients’ privacy but may have to disclose personal information when required under law only if we believe that such action is required in good-belief to comply with a judicial proceeding, court order, subpoena or any other legal process served on us.

16. As inherent in the electronic and digital media, artflares is not responsible for any overt or covert

use of information about our products, services or clients by an unauthorized person/ party although

we employ strict measures to protect such confidentiality and, particularly sensitive information like credit card numbers which are encrypted as safeguards. As such, we’re not liable for any damage: direct, special, incidental, consequential, punitive, exemplary or otherwise. In any eventuality, our liability shall not exceed the list price received by us against such sale.

17. We’ve no tracking of or control over our having permitted the exhibition, publication or showing of

our `artworks’ prior to their sale and, can’t stop such use sooner or later either.

18. Acts of `Force Majeures’—- God-made or man-made, are beyond our control and don’t hold us liable.

19. Our terms and prices are subject to change without notice.
